By accessing or using PMFtracker ("Service"), available at https://www.pmftracker.com/, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms constitute a legally binding agreement between you ("User" or "you") and PMFtracker ("we," "us," or "our").

2. Description of Service

PMFtracker is a software-as-a-service platform that provides systematic measurement, tracking, and validation of product-market fit through quantitative benchmarks and qualitative customer insights. Our Service includes analytics dashboards, survey tools, data visualization, and integration capabilities with third-party platforms.​

3. User Accounts and Registration

To access certain features of our Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use of your account.

4. Permitted Use

You may use our Service for legitimate business purposes to measure and track product-market fit for your products or services. You are granted a limited, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms.

5. Prohibited Uses

You agree not to use our Service to:

• Engage in illegal activities or violate any applicable laws

• Attempt to gain unauthorized access to our systems or other users' accounts
  
• Use the Service to harass, abuse, or harm others

6. Intellectual Property Rights

Our Intellectual Property
ProducTrio (the company operating PMFtracker) owns and retains all rights to:

• Our proprietary software platform, code, and algorithms
  
• The PMFtracker brand, logos, and trademark materials
  
• Our website design, user interface, and user experience elements
  
• Proprietary analytics dashboards and data visualization tools
  
• Our specific implementation and automation of survey methodologies
  
• Documentation, guides, and educational content we create
  

Third-Party Methodologies and Frameworks
Our platform incorporates established product-market fit measurement methodologies, including:

• The Sean Ellis Test (40% rule) - a widely-used, publicly available framework developed by Sean Ellis
  
• Standard PMF survey questions and benchmarking approaches from the broader startup and product management community
  
• Industry-standard analytics and measurement techniques
  

We do not claim ownership of these established methodologies, which remain available for public use. Our intellectual property lies in our specific software implementation, automation, and enhancement of these methodologies.

Respect for Others' IP
‍You agree not to use our platform to:

• Infringe on others' intellectual property rights
  
• Upload copyrighted material without permission
  
• Violate trademark or trade secret rights of third parties
  

7. User Data and Content

You retain full ownership of:

• All data, survey responses, and business information you input into our platform
  
• Your PMF survey results, analytics, and reports generated from your data
  
• Any customizations or configurations you create within our platform
  

By using our Service, you grant us a limited, non-exclusive license to process, store, and analyze your data solely for the purpose of providing our platform services. We will not claim ownership of your business data or share your proprietary information with competitors.

8. Payment Terms and Subscriptions

Access to certain features of our Service may require payment of subscription fees. All fees are non-refundable unless otherwise specified. Subscription fees will be charged in advance on a recurring basis. We reserve the right to modify our pricing with 30 days' notice to existing subscribers.

9. Data Integration and Third-Party Services

Our Service integrates with third-party platforms including PostHog and supports CSV data uploads from various survey tools. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability or functionality of third-party services.

When you use third-party integrations (such as PostHog), you acknowledge that such services are governed by their respective terms of service and intellectual property policies. We are not responsible for third-party intellectual property claims related to integrated services.

10. Service Availability and Modifications

We strive to maintain Service availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any aspect of our Service with reasonable notice. We may also update these Terms periodically, with changes taking effect upon posting.

11. Termination

Either party may terminate your account at any time. We may terminate or suspend your access immediately for violation of these Terms. Upon termination, your right to access the Service ceases, but provisions regarding intellectual property, limitation of liability, and dispute resolution shall survive.

12. Limitation of Liability

To the maximum extent permitted by law, PMFtracker shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

13. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, secure, or continuously available. PMF measurement results should be used as guidance and do not guarantee business success.

14. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. The relationship between you and ProductTrio (the company operating PMFtracker) shall be governed by Polish law.
Any disputes, claims, or legal proceedings arising out of or relating to these Terms, your use of our Service, or your relationship with ProductTrio shall be subject to the exclusive jurisdiction of the competent courts in Wrocław, Poland.
By using our Service, you expressly consent to the personal jurisdiction of the courts located in Wrocław, Poland, and waive any objection to venue in such courts. This jurisdiction clause applies to all users regardless of their location.
Before initiating court proceedings, we encourage parties to attempt to resolve disputes through good faith negotiations. If direct negotiations fail, disputes may be submitted to mediation or arbitration through the Lower Silesian Chamber of Commerce in Wrocław, subject to mutual agreement of both parties.
If any provision of these Terms is deemed invalid or unenforceable by a Polish court, the remaining provisions shall remain in full force and effect. Any judgment obtained in Polish courts may be enforced in other jurisdictions in accordance with applicable international treaties and local enforcement procedures.
For users located within the European Union, this jurisdiction clause is subject to applicable EU regulations, including the Brussels I Regulation (recast), which may provide additional rights regarding jurisdiction and enforcement of judgments.​
